Chiefs defensive end Jared Allen pleaded no contest Wednesday in Leawood Municipal Court to his second charge of driving under the influence of alcohol.
Judge Renee Gurney found him guilty and sentenced him to two days in jail, two days in a lockdown drug-treatment program and one day of house arrest. Allen is to enter the treatment program at 5 p.m. Friday and report to the Johnson County Jail at 5 p.m. Sunday. Upon his release, he will serve one day under house arrest.
Before the sentence was imposed, Allen and his attorney, Kevin Regan, spent more than 40 minutes at the judge’s bench, talking with her in barely audible tones. Afterward, Allen paid a $1,000 fine (part of the penalty), autographed a ball cap for a fan who approached him in the hall and walked out of the building. He and Regan declined to comment.
Allen was charged Sept. 26 with driving under the influence in Leawood. Police stopped him at 1:25 a.m. that day at 135th Street and Roe Avenue. Allen declined to take a breath-alcohol test.
At the time, Allen was participating in a court program stemming from a DUI charge in Overland Park on May 11. Typically, if such a diversion program is completed successfully, the charge is dismissed.
However, Allen’s arrest in Leawood violated the terms of the program for the first charge. On Jan. 3, an Overland Park judge found him guilty in the May incident.
Under Kansas law, a person’s first and second DUIs are misdemeanors. The third is a felony.
